K&N’s “2012 NASCAR Sprint Cup Series Champion’s Week™ in Vegas” Sweepstakes Official Rules

DATES OF PROMOTION: K&N’s “2012 NASCAR Sprint Cup Series Champion’s Week™ in Vegas” Sweepstakes (the “Sweepstakes”) begins at12:00 p.m. Eastern Time (“ET”) on August 16, 2012 and ends at 2:00 p.m. ET on November 5, 2012 (the “Sweepstakes Period”).
ELIGIBILITY: In order to be eligible for entry into the Sweepstakes, you must be a legal citizen or permanent legal resident of the 50 United States or the District of Columbia who are 18 years of age or older or the age of majority in which they reside and have a valid Social Security number and valid driver’s license at the time of entry. Employees and their immediate family members (parents, children, siblings or spouse, regardless of where they live, or persons living in same household, whether related or not) of K & N Engineering, Inc. (the “Sponsor”), NASCAR, Inc., and Sprint, their subsidiaries, and each of their respective parent companies, divisions, affiliates, contractors, subsidiaries, sales representatives, advertising and promotion agencies, and any others engaged in the development, production, execution or distribution of this Sweepstakes, including but not limited to, National Sweepstakes Company, LLC (the “Sweepstakes Administrator (collectively, herein the “Released Parties”), are not eligible to participate. Sweepstakes is void in Puerto Rico, U.S. territories and possessions outside of the 50 United States and where restricted or prohibited by law.
Grand Prize winner is required to travel on November 28, 2012 and complete travel on December 1, 2012 and must be able to attend all required race and publicity events or prize will be forfeited (as discussed below).
HOW TO ENTER: Visit www.knfilters.com and complete/submit the Official Online Entry Form in its entirety including your first name, last name, address, city, state, zip, age, e-mail address, daytime phone number and short questionnaire. In order for an online entry to be valid, entrant must have a valid e-mail address and must check the box stating that you have read and agree to these Official Rules and then click the “submit” button. All online entries must be submitted by 2:00 pm ET on November 5, 2012. Neither Sponsor nor any Released Parties are responsible for any online entry that is lost, late, misdirected or undeliverable, whether due to system errors, omissions, interruption, deletions, defects, delay in operations or transmissions, theft or destruction or failures, faulty transmissions or other telecommunications malfunctions, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise.
In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed submitted by the authorized account holder of the e-mail address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the e-mail address by an Internet access provider, on-line service provider, or other organization that is responsible for assigning e-mail addresses, or the domain associated with the submitted e-mail address. Potential winners may be required to show proof of being the authorized account holder.
Limit one (1) entry per person/email address throughout the entire Sweepstakes Period.
Any attempt by an entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations, logins, and/or any other methods, including, but not limited to, automated entry, will void that entrant’s entries and that entrant will be disqualified from the Sweepstakes. Entry information must be manually key-stroked. Neither the Sponsor nor Sweepstakes Administrator will verify receipt of entries for entrants. All entries submitted become the sole property of Sponsor and will not be returned.
DRAWINGS: On or about November 6, 2012, a Grand Prize winner the will be selected in a random drawing conducted under the supervision of the Sweepstakes Administrator, an independent judging organization, whose decisions are based on their sole discretion and interpretation of these official rules, and are final and binding in all respects. Odds of winning are dependent upon the total number of entries received.
PRIZE: One (1) Grand Prize of a trip for Grand Prize winner and guest to the NASCAR Sprint Cup Series Champion’s Week™ in Las Vegas, NV from November 28, 2012 through December 1, 2012. Grand Prize includes: a) roundtrip coach airfare from a major airport closest to the Grand Prize winner’s residence to Las Vegas, NV b) three (3) nights standard accommodations at a hotel determined by Sponsor in its sole discretion; c) $150 cash to be used towards ground transportation, d) Access for two (2) to the NASCAR 2012 Champion’s Week events, and e) Meet & Greet lunch for winner and guest. Grand Prize winner and guest must start travel on November 28, 2012 and complete travel on December 1, 2012 (or on such other dates determined by Sponsor in its sole discretion so as to attend the events) and be able to attend all scheduled events or prize will be forfeited in its entirety. Travel must be roundtrip. Sponsor and the Released Parties are not responsible for airline cancellations or delays. All expenses and incidental travel costs not expressly stated in the Grand Prize description above, including but not limited to, ground transportation, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, meals, personal charges at lodging, security fees, taxes or other expenses or incidentals are the responsibility solely of the Grand Prize winner. Any taxes imposed on the income of the Grand Prize winner as a result of winning the Grand Prize and all other expenses not specifically mentioned herein as part of the Grand Prize are solely the responsibility of the Grand Prize winner. All travelers must possess required travel documents (e.g. valid government-issued photo I.D.) prior to departure. Travel restrictions, conditions and limitations may apply. No transfer or substitution of prize is allowed except at the sole discretion of the Sponsor due to prize unavailability for any reason and only then for prize comparable value. There is no cash alternative offered, except at the sole discretion of the Sponsor. The Grand Prize winner is required to comply with any and all applicable federal, state and local laws, rules and regulations. The value of the Grand Prize is taxable as income and Grand Prize winner is solely responsible for all matters relating to the Grand Prize, including, but not limited to all applicable federal, state and local taxes that become due with respect to the Grand Prize. Actual retail value will vary depending on the departure airport of Grand Prize winner. Any difference between the stated Approximate Retail Value (“ARV”) of the Grand Prize and the actual value will not be awarded. The ARV of the Grand Prize is $2,900.
PRIZE CLAIM: Except where prohibited, potential Grand Prize winner will need to sign and return within timeframe specified by the Independent Sweepstakes Administrator, an Affidavit of Eligibility/Liability/Publicity Release Form, Travel Companion Form and an IRS Form W-9 (collectively, the “Paperwork”) in order to claim their prize. If potential Grand Prize winner fails to return the Paperwork by the dates required, he/she forfeits his/her right to their prize (without compensation of any kind) and an alternate Grand Prize winner will be selected at random from among all remaining non-winning entries received, at Sponsor’s sole discretion. If Sponsor or Independent Sweepstakes Administrator is unable to award the Grand Prize after four attempts to notify a Grand Prize Winner, the Grand Prize will not be awarded. Potential Grand Prize winner’s receipt of respective Grand Prize may be reported as income to the Internal Revenue Service. In the event it is deemed during the verification process that potential Grand Prize winner does not have a unique, personal and valid social security number for Sponsor to report the tax liability associated with acceptance of the Grand Prize, he/she will be disqualified and an alternate Grand Prize winner will be selected at random from among all remaining non-winning entries received, at Sponsor’s sole discretion, time permitting. Valid social security numbers will be determined by IRS requirements.
Potential Grand Prize winner consents to use of his/her name, likeness, biographical information, and voice in advertising worldwide without additional compensation (TN residents will not be required to sign a Release as a condition of winning a prize). Grand Prize winner will be issued an IRS 1099 form for the actual value of the Grand Prize for the year in which actual prize value was received.
GENERAL RULES OF PARTICIPATION: By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the judges, which are final in all respects and not subject to appeal. Sponsor reserves the right to disqualify from this Sweepstakes any entrant it believes has violated these Official Rules. By participating in this Sweepstakes, entrants, and winners release the Sponsor and each and all of the Released Parties (and the officers, directors, employees, shareholders, agents and representatives of any of the Released Parties), from any and all liability, damages or causes of action (however named or described) with respect to or arising out of participation in the Sweepstakes, and/or the receipt or use/misuse of the prizes awarded, including, without limitation, liability for personal injury, death or property damage. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. All Sweepstakes materials are subject to verification and are void if (a) not obtained in accordance with these Official Rules and through legitimate channels, (b) any part is counterfeited, altered, defective, damaged, illegible, reproduced, tampered with, mutilated or irregular in any way, (c) are obtained where prohibited, or (d) they contain printing, typographical, mechanical, or other errors. Entrants assume all risk of loss, damage, destruction, delay or misdirection of Sweepstakes materials submitted to Sponsor. Winning a prize constitutes permission for Sponsor and its agencies to use winners' names, addresses (city & state), voices and/or likenesses for purposes of advertising, promotion and publicity, for this promotion only, without further compensation, unless prohibited by law. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants, Sponsor, or Released Parties. If for any reason this Sweepstakes is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes (in whole or in part), then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and select the Finalists and/or Grand Prize winner in a manner deemed by Sponsor in its sole discretion to be fair, appropriate and consistent with the spirit of these Official Rules. Notice of such action by Sponsor will be posted on Sweepstakes website. CAUTION: ANY ATTEMPT BY AN ENTRANT TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
NO LIABILITY: By participating, entrants agree to release, discharge, indemnify and hold harmless the Sponsor and each and all of the Released Parties (and the officers, directors, employees, shareholders, agents and representatives of any of the Released Parties), from and against any claims made by Finalists, Alternate Finalist, entrants, or any other third parties, related in any way to the operation of this Sweepstakes as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize(s) or participation in any Sweepstakes-related activity or participation in this Sweepstakes.
PRIVACY: Your personal information, in conjunction with this Sweepstakes, will be utilized by the Sponsor and its designated agents for the purpose of selecting a Prize winner and for statistical research and in-house marketing purposes only. All requests must be received by November 16, 2012 (VT residents may omit return postage). To have your name & address removed from Sponsor’s sweepstakes mailing list, send a SASE to P.O.
