DATES OF PROMOTION:
“The K & N 2010 Horsepower Challenge” Sweepstakes (the “Sweepstakes”)
begins at 3:00 p.m. Pacific
Time (“PT”) on December 23, 2009 and
ends at 12:00 p.m. PT on May 24, 2010 (the
“Sweepstakes Period”).
ELIGIBILITY:
In order to be eligible
for entry into the Sweepstakes, you must be a legal citizen or permanent
legal resident of the 50 United States or the District of Columbia,
excluding residents of New York and Florida, who are 18 years of age or
older or the age of majority in which they reside, can comprehend and
speak the English language (both verbal and written), and have a valid
Social Security number and valid driver’s license at the time of entry.
Employees and their immediate family members (parents, children,
siblings or spouse, regardless of where they live, or persons living in
same household, whether related or not) of K & N Engineering, Inc. (the
“Sponsor”), Harley-Davidson® Motor Company,
Inc. its subsidiaries, and each of their respective parent
companies, divisions, affiliates, contractors, subsidiaries,
sales representatives, advertising and
promotion agencies, and any others engaged in the development,
production, execution or distribution of this Sweepstakes, including but
not limited to, The National Sweepstakes Company (the “Sweepstakes
Administrator”) (the “Sweepstakes Entities”), are not eligible to
participate. Sweepstakes is void in Florida, New York, Puerto Rico, U.S.
territories and possessions outside of the 50 United States (other than
Florida and New York), and where restricted or prohibited by law.
Finalists are required to
travel on JUNE 24TH, 2010 and complete travel on JUNE 27TH,
2010 and must be able to attend all required race and publicity events
or prize will be forfeited (as discussed below).
HOW TO ENTER:
Visit www.knfilters.com
and complete/submit the Official Online Entry Form in its entirety
including your first name, last name, address, city, state, zip, age,
e-mail address, daytime phone number and short questionnaire. In order
for an online entry to be valid, entrant must have a valid e-mail
address and must check the box stating that you have read and agree to
these Official Rules and then click the “submit” button. All online
entries must be submitted by 11:59 pm ET on
MAY 24, 2010. Neither Sponsor
nor any Sweepstakes Entity is responsible for any online entry that is
lost, late, misdirected or undeliverable, whether due to system errors,
omissions, interruption, deletions, defects, delay in operations or
transmissions, theft or destruction or failures, faulty transmissions or
other telecommunications malfunctions, entries not received resulting
from any hardware or software failures of any kind, lost or unavailable
network connections, failed, incomplete or garbled computer or telephone
transmissions, typographical or system errors and failures, faulty
transmissions, technical malfunctions, or otherwise. In the event of a
dispute regarding the identity of the person submitting an entry, the
entry will be deemed submitted by the authorized account holder of the
e-mail address submitted at the time of entry.
The authorized account holder is the natural person who is
assigned to the e-mail address by an Internet access provider, on-line
service provider, or other organization that is responsible for
assigning e-mail addresses, or the domain associated with the submitted
e-mail address. Potential winners may be required to show proof of being
the authorized account holder.
Limit one (1) entry per person/email
address throughout the entire Sweepstakes Period. Any attempt by an
entrant to obtain more than the stated number of entries by using
multiple/different email addresses, identities, registrations, logins,
and/or any other methods, including, but not limited to, automated
entry, will void that entrant’s entries and that entrant will be
disqualified from the Sweepstakes.
Entry information must be manually key-stroked. Neither the Sponsor
nor Sweepstakes Administrator will verify receipt of entries for
entrants. All entries
submitted become the sole property of Sponsor and will not be returned.
DRAWINGS:
FINALIST DRAWING:
On or about May 26, 2010, eight (8)
Finalist Prize winners (the “Finalist”) will be selected in a random
drawing conducted under the supervision of The National Sweepstakes Co.,
an independent judging organization, whose decisions are based on their
sole discretion and interpretation of these official rules, and are
final and binding in all respects.
Odds of being selected as a
Finalist and winning Finalist Prize are dependent upon the total number
of eligible entries received.
GRAND PRIZE
SELECTION PROCESS:
On June 26, 2010, Finalists will attend a publicity
event prior to the K&N Horsepower Challenge Race (the “Race”) scheduled
for that day (the “Event”).
At the Event, each Finalist will select their professional Pro Stock
driver in the order in which a third party Representative pulls the
Finalist’s name. Each Finalist will then randomly select one (1) of the
eight (8) professional Pro Stock drivers participating in the Race and
will be assigned that professional Pro Stock driver.
On June 26, 2010, the Grand Prize winner will be determined based
upon the Finalist who is paired with the professional Pro Stock driver
that wins the Race according to the official race results as certified
by the NHRA. Odds of winning the
Grand Prize are approximately 1:8 but depend on the actual number of
Finalists that are confirmed and attend the Event, which driver a
Finalist is randomly paired with, and that driver’s performance in the
Race/the official Race results.
If a Finalist can not be
confirmed prior to the Event or does not attend the Event for any
reason, then only the total number of Finalists who were verified and
are actually in attendance at the Event will be paired with a
professional driver. In the Event that the
winning professional driver is not paired with a Finalist, the Grand
Prize winner will be determined based upon the finalist paired with the
professional driver who finishes the race in the next best time (according
to the official race results as certified by the NHRA). In the
event the Race is cancelled, the Grand Prize winner will be selected in
a random drawing from among the actual number of confirmed Finalists and
will be conducted under the supervision of the Representative present at
the Selection Process or the National Sweepstakes Company, whose
decisions are based on their sole
discretion and interpretation of these official rules, and are final and
binding in all respects. PRIZES FINALIST PRIZES:
Eight (8) Finalist Prizes
of a
trip for Finalist Prize winner to
the “SUMMIT RACING EQUIPMENT
NHRA NATIONALS” in
NORWALK, OHIO from
JUNE 24, 2010 through
JUNE 27, 2010 (the “Prize
Trip Package”).
Prize Trip Package includes: i) $800 travel voucher for the
following: a) roundtrip coach-class air travel for Finalist Prize winner
(ARV: $500, b) ground transportation to/from hotel/airport (ARV: $200),
and c) $100 spending money, ii) a maximum of four (4) days and three (3)
nights standard accommodations at a hotel determined by Sponsor in its
sole discretion; iii) one (1) Full event credential and suite
pass to the NHRA Nationals race and all
scheduled race events.
FINALISTS ARE
RESPONSIBLE FOR BOOKING THEIR FLIGHTS AND ALL TRANSPORTATION.
Finalists must start travel on JUNE 24, 2010 and complete travel on JUNE
27, 2010(or on such other dates determined by Sponsor in its sole
discretion so as to attend the Race) and be able to attend all scheduled
race events or prize will be forfeited in its entirety and an alternate
Finalist will be selected from among all remaining eligible entries
received. Travel must be roundtrip.
Sponsor is not responsible for airline cancellations or delays.
All expenses and incidental travel costs not expressly stated in the
Prize Trip Package description above, including but not limited to,
ground transportation, passenger tariffs or duties, surcharges, airport
fees, service charges or facility charges, meals, personal charges at
lodging, security fees, taxes or other expenses or incidentals are the
responsibility solely of Finalist. Any taxes imposed on the income of
the Finalist as a result of winning the Finalist Prize and all other
expenses not specifically mentioned herein as part of the Finalist Prize
are solely the responsibility of the Finalist. All travelers must
possess required travel documents (e.g. valid government-issued photo
I.D.) prior to departure. Travel restrictions, conditions and
limitations may apply.
No transfer or substitution of prize is
allowed except at the sole discretion of the Sponsor due to prize
unavailability for any reason and only then for prize comparable value.
There is no cash alternative offered, except at the sole discretion of
the Sponsor. The winner is required to comply with any and all applicable federal,
state and local laws, rules and regulations.
The value of the prize is taxable as income and Finalist is
solely responsible for all matters relating to the prize, including, but
not limited to all applicable federal, state and local taxes that become
due with respect to the prize.
Actual retail value will vary depending on the departure
GRAND PRIZE: One (1) Grand Prize of a
2010 Harley-Davidson Street Bob Motorcycle, having a Manufacturer’s
Suggested Retail Price (the “MSRP”) of $13,000.00 (Street Bob Color,
Options and Accessories to be determined at the sole discretion of the
Sponsor or Harley-Davidson Motor Company, Inc.
unless selection specifically granted to Grand Prize winner by
Harley-Davidson Motor Company, Inc) Grand Prize winner must have
and provide a valid U.S. Driver’s License and proof of acceptable
Insurance Coverage before being awarded the Grand Prize.
The Grand Prize winner is required to comply with any and all
applicable federal, state and local laws, rules and regulations
including, but not limited to licensing and insurance requirements. The
value of the Grand Prize is taxable as income (Grand Prize winner will
be taxed on the combined value of the Grand Prize AND the Finalist
Prize). Grand Prize winner will be solely responsible for any applicable
registration, license, title and insurance fees, all taxes (federal,
state, local and/or income) and any expenses not listed herein related
to the acceptance and use of the Grand Prize.
Prize is non-transferable and no cash redemption or substitution
allowed, except at Sponsor’s sole discretion.
Sponsor reserves the right to substitute a prize of equal or
greater value if prize becomes unavailable due to reasons beyond the
control of the Sponsor. Any
difference between the stated MSRP of the Grand Prize and the actual
value will not be awarded. All taxes are the sole responsibility
of the winner. The MSRP of the Grand Prize is $13,000.00. Total ARV of all
prizes to be awarded is $24,424.00.
Names of prize manufacturers are used
solely for the purposes of identification of the prize. No endorsement,
authorization, sponsorship, or approval of Harley-Davidson
Motor Company, Inc. for this Promotion is intended or implied.
PRIZE CLAIM:
FINALIST NOTIFICATION:
After first being selected, Finalists will be contacted by telephone.
If the Finalist cannot be contacted within 48 hours of the first attempt
to contact the Finalist, then that Finalist will be disqualified and an
alternate Finalist will be selected, time permitting.
In the event that the alternate Finalist can not be contacted
then a Finalist will not participate in the Grand Prize Selection
Process (the “Selection Process”) Event and only the confirmed
Finalists will be eligible to participate in the Selection Process.
In order to be eligible to participate in the Selection Process,
all Finalists must be available to be present at all required Race
Events to be held in NORWALK,
OHIO from JUNE 24, 2010 to JUNE 27,
2010. If a Finalist is unable to attend any of the required Race
Events then that Finalist forfeits the ability to participate in the
Grand Prize Selection Process.
FINALIST PRIZE
CLAIM:
Once Finalists have been contacted,
except where prohibited, the potential Finalist must sign and return,
within three (3) days of receipt, an Affidavit of
Eligibility/Liability/Publicity Release and an IRS W-9 Form, proof of
insurance, and valid driver’s license, (the “Paperwork”) in order to
claim prize. If potential
Finalist fails to sign and return the Paperwork within three (3) days of
the date notified, potential Finalist forfeits
their right to the Finalist Prize and an alternate Finalist will
be selected, time permitting. Potential
Finalist consents to use of his/her name, likeness, biographical
information, and voice in advertising worldwide without additional
compensation (TN residents will not be required to sign a Release as a
condition of winning a prize). Prize winners will be issued an
IRS 1099 form for the actual value of the Prize for the year in which
actual prize value was received.
GRAND PRIZE CLAIM:
Except where
prohibited, the potential Grand Prize winner must sign and return,
within five (5) days of receipt, an Affidavit of
Eligibility/Liability/Publicity Release, and an IRS W-9 Form (the
“Paperwork”) and provide proof of insurance and a valid driver’s license
in order to claim prize.
Potential Grand Prize winner must sign
and return the Paperwork before he or she is able to take possession of
the Grand Prize If the
potential Grand Prize winner is unable to
provide the Paperwork within five (5) days of selection as the Grand
Prize winner, then that winner forfeits their right to the Prize
and the Grand Prize will be
awarded to the next Finalist paired with the
professional driver who finishes the race in the next best time (according to the official race results as certified by the NHRA).
Potential Grand Prize winner consents to use
of his/her name, likeness, biographical information, and voice in
advertising worldwide without additional compensation (TN residents will
not be required to sign a Release as a condition of winning a prize).
Prize winners will be issued an IRS 1099 form for the actual
value of the Prize for the year in which actual prize value was
received.
GENERAL RULES OF PARTICIPATION:
By participating in this Sweepstakes, entrants agree to be bound by
these Official Rules and the decisions of the judges, which are final in
all respects and not subject to appeal.
Sponsor reserves the right to disqualify from this Sweepstakes
any entrant it believes has violated these Official Rules.
By participating in this Sweepstakes, entrants, and winners
release the Sponsor and each and all of the Sweepstakes Entities (and
the officers, directors, employees, shareholders, agents and
representatives of any of the Sweepstakes Entities), from any and all
liability, damages or causes of action (however named or described) with
respect to or arising out of participation in the Sweepstakes, and/or
the receipt or use/misuse of the prizes awarded, including, without
limitation, liability for personal injury, death or property damage.
Failure to comply with these Official Rules may result in
disqualification from the Sweepstakes.
All Sweepstakes materials are subject to verification and are
void if (a) not obtained in accordance with these Official Rules and
through legitimate channels, (b) any part is counterfeited, altered,
defective, damaged, illegible, reproduced, tampered with, mutilated or
irregular in any way, (c) are obtained where prohibited, or (d) they
contain printing, typographical, mechanical, or other errors.
Entrants assume all risk of loss, damage, destruction, delay or
misdirection of Sweepstakes materials submitted to Sponsor. Winning a
prize constitutes permission for Sponsor and its agencies to use
winners' names, addresses (city & state), voices and/or likenesses for
purposes of advertising, promotion and publicity, for this promotion
only, without further compensation, unless prohibited by law.
Sponsor may prohibit an entrant from participating in the
Sweepstakes or winning a prize if, in its sole discretion, it determines
that said entrant is attempting to undermine the legitimate operation of
the Sweepstakes by cheating, deception, or other unfair playing
practices (including the use of automated quick entry programs) or
intending to annoy, abuse, threaten or harass any other entrants,
Sponsor, or Sweepstakes Entities. If for any reason this Sweepstakes is
not able to be conducted as planned, including, but not limited to, by
reason of infection by computer virus, bugs, tampering, unauthorized
intervention, fraud or any other causes beyond the reasonable control of
Sponsor which corrupt or affect the administration, security, fairness,
integrity or proper conduct of the Sweepstakes (in whole or in part),
then Sponsor reserves the right at its sole discretion to cancel,
terminate, modify or suspend the Sweepstakes and select the Finalists
and/or Grand Prize winner in a manner deemed by Sponsor in its sole
discretion to be fair, appropriate and consistent with the spirit of
these Official Rules. Notice of such action by Sponsor will be posted on
Sweepstakes website.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO UNDERMINE THE LEGITIMATE
OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL
LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO
SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH
ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL
PROSECUTION. NO LIABILITY: By participating, entrants agree to release, discharge, indemnify and hold harmless the Sponsor and each and all of the Sweepstakes Entities (and the officers, directors, employees, shareholders, agents and representatives of any of the Sweepstakes Entities), from and against any claims made by Finalists, entrants, or any other third parties, related in any way to the operation of this Sweepstakes as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize(s) or participation in any Sweepstakes-related activity or participation in this Sweepstakes.
PRIVACY: Your
personal information, in conjunction with this Sweepstakes, will be
utilized by the Sponsor and its designated agents for the purpose of
selecting a Prize winner and for statistical research and in-house
marketing purposes only. No information will be sold or provided to
